NEW HAMPSHIRE LEGISLATION PROPOSES HOUSE BILL # 1231, TITLED “RELATIVE TO FAILURE TO MAKE PAYMENT OF COMPENSATION”.

This bill, introduced on January 5, 2022, provides for penalties against workers’ compensation insurance carriers or self-insured entities that make late benefit payments to injured workers.

Specifically, if payments are more than 60 days late and if the employee’s average weekly wage (AWW) is more than 30% of the state’s AWW, then the compensation shall be 100% of the employee’s AWW or 50% of the state’s AWW, whichever is higher. The bill also limits the maximum penalty to 250% of the state’s AWW.

A public hearing was held yesterday and will be discussed further on January 27, 2022 in the State House Executive Session.
